Child Protection

I. Preliminary Provisions

Pursuant to the Act of 13 May 2016 on Counteracting Threats of Sexual Crime and the Protection of Minors, the Standards for the Protection of Minors (hereinafter referred to as the Standards) are hereby established, taking into account the rights of children, in particular their right to the protection of their dignity and freedom from any form of harm, both physical and psychological.
The purpose of the Standards is to prevent all forms of harm to children through the introduction of procedures and rules.

1. Whenever the Standards refer to:

Hotel – this shall mean Hotel Bulwar located at Bulwar Filadelfijski 18, 87-100 Toruń,

Hotel Director – this shall mean the person authorized to manage the Hotel, even if only temporarily,

Hotel Employee – this shall mean any person performing work for the Hotel under an employment contract or any other legal relationship,

Minor – this shall mean any person under 18 years of age.

2. The procedures and rules specified in these Standards shall be applied with respect for the personal rights of the Hotel’s guests.

3. In contacts with minors, Hotel Employees are obliged to take into account their level of development, including their intellectual and emotional development.

II. Principles Ensuring Safe Contact Between Minors and Hotel Employees, in Particular Protecting Minors from Harm

All contacts between Hotel Employees and minors should not exceed what is justified by the employee’s professional duties and actual necessity.

1. A Hotel Employee should avoid situations in which they remain alone with a minor in a single room, unless this is necessary due to professional duties or the need to protect the minor’s health or life. In such cases, whenever possible, the employee should ensure the presence of another employee or a person assisting them.

2. The Hotel provides employees with training on procedures and rules regarding working with minors.

3. Persons employed by the Hotel to work with minors must be safe and suitable to work with them.

4. Persons employed for the purpose of education, recreation, or leisure activities for minors must be checked in the Register of Sex Offenders. Such verification must be repeated once a year.

5. All Hotel Employees who may have contact with children must submit a declaration confirming that they have no criminal record and that no proceedings concerning offenses against minors are pending against them.

III. Rules and Procedures for Identifying a Minor Staying at the Hotel and Their Relationship with the Adult Accompanying Them

1. Reception staff, when checking in a minor at the Hotel, shall verify the child’s identity and their relationship with the adult with whom the child will stay at the Hotel.

2. The identity of the child shall be established on the basis of the minor’s identity documents. In the absence of identity documents, the identity of the minor shall be established based on a conversation with the person with whom the minor will be staying on the Hotel premises.
 If the person accompanying the child is neither the child’s parent nor legal guardian, the adult should be asked to provide proof that the minor remains under their care with the consent of the child’s parent or legal guardian.

3. If, during the process of establishing the identity of the minor and their relationship with the accompanying adult, the reception employee develops reasonable doubts regarding the relationship between the adult and the child staying at the Hotel, the employee is obliged to inform the Hotel Director of such doubts. The notification should be made in a manner that does not arouse suspicion from the adult staying with the minor at the Hotel. During this time, continuous observation of the adult and the minor should be ensured by Hotel Employees.

4. During the conversation with the minor, it should be ensured that the child has the opportunity to speak freely, without being influenced by the presence of the adult with whom the child arrived at the Hotel, in particular so that the adult does not answer questions addressed to the minor.
If the adult in any way prevents or hinders the conversation with the minor, the employee should ask the adult to leave the room where the conversation with the minor is being conducted. In such a situation, the employee should also ensure the presence of another employee in the room during the conversation.

IV. Rules and Procedures for Responding in Case of Reasonable Suspicion that the Welfare of a Minor at the Hotel is at Risk

1. In the event of a situation giving rise to suspicion that the welfare of a child is at risk, each Hotel Employee is obliged to take appropriate action.

2. Suspicion of harm to a minor arises in particular when an employee observes circumstances indicating possible harm to the child or when the minor reports such harm themselves.

3. Situations referred to in paragraphs 1 and 2 must be immediately reported by Hotel Employees to the Hotel Director, and if this is not possible or would cause delay, the matter should be reported to the direct supervisor or the Police.

4. If possible, the Hotel Employee should take immediate action aimed at stopping the harm to the minor; however, such actions must remain within the limits permitted by law.

5. After being informed of the situations described in these Standards, the Hotel Director should immediately examine the circumstances of the case and, if the findings indicate reasonable suspicion of harm to a minor, is obliged to notify law enforcement authorities.

6. If the Police are notified, the Hotel Director and Employees should ensure, until the arrival of Police officers, that the child and the person who may have potentially committed an offence against the minor do not leave the Hotel premises and that they do not remain alone together.

V. Scope of Responsibilities of the Person Responsible for Preparing Hotel Employees to Apply the Standards, Principles of Training Employees, and Documentation of This Process

1. The person responsible for preparing and training employees to comply with and apply these Standards, as well as for conducting the required training, is the Hotel Director.

2. The Hotel Director may designate another person to prepare and conduct employee training on the application of the Standards.

3. The training shall be documented by an attendance list of employees participating in the training.

VI. Final Provisions

1. These Standards shall be reviewed at least once every two years to verify their validity and their adaptation to current circumstances.

2. The Standards shall be made available on the website: www.hotelbulwar.pl
and shall also be displayed in a visible place at the hotel reception, both in the full version and in a shortened version intended for minors.
